Terms of Service for Bod AI

These Terms of Service ("Terms") govern your use of the Bod AI iOS app and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1) Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service.

If you are under the age of majority where you live, you may use the Service only with appropriate parent or guardian permission.

2) Health and Safety Disclaimer

Bod AI provides fitness guidance for informational and educational purposes only.

Bod AI is not medical advice, diagnosis, or treatment, and does not replace a licensed healthcare professional.

You are responsible for determining whether activity is appropriate for you.

Stop exercising and seek medical advice if you feel pain, dizziness, or other concerning symptoms.

3) Accounts

You are responsible for activity under your account and for maintaining account/device security.

You agree to provide accurate information and keep it updated.

We may suspend or terminate access if we believe your use violates these Terms, applicable law, or risks harm to users or the Service.

4) Subscriptions, Billing, and Renewal

Some features require a paid subscription.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Renewal charges are processed within 24 hours before the current period ends.
• You can manage and cancel subscriptions in your App Store account settings.
• Refunds are handled by Apple under App Store policies.

Pricing, plans, and feature availability may change where permitted by law.

5) License and Acceptable Use

Subject to these Terms, Bod AI grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code except where legally permitted.
• Circumvent paywalls, entitlement checks, security controls, or access restrictions.
• Use the Service for unlawful, abusive, fraudulent, or harmful conduct.
• Interfere with Service operation or other users.

6) User Content

You may provide content such as profile details and photos.

You retain ownership of your content. You grant Bod AI a limited license to host, process, and use that content solely to operate, improve, and provide the Service in accordance with our Privacy Policy.

You are responsible for ensuring you have rights to any content you upload.

7) Intellectual Property

The Service, including software, design, branding, and content (excluding your content), is owned by Bod AI and protected by intellectual property laws.

No rights are granted except as expressly stated in these Terms.

8) Third-Party Services

The Service may integrate third-party providers (for example, Apple, Supabase, RevenueCat, analytics and AI providers).

Your use of third-party services may also be subject to their terms and policies.

9) Disclaimer of Warranties

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, Bod AI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, error-free, or completely secure operation.

10) Limitation of Liability

To the fullest extent permitted by law, Bod AI and its affiliates, officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business interruption arising from or related to your use of the Service.

If liability cannot be excluded, Bod AI's aggregate liability is limited to the greater of:

(a) amounts you paid to Bod AI for the Service in the 12 months before the claim, or

(b) USD $100.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11) Indemnification

You agree to indemnify and hold harmless Bod AI from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.

12) Termination

You may stop using the Service at any time.

We may suspend or terminate access at any time for violations of these Terms, legal risk, security issues, or misuse.

Sections that by nature should survive termination (for example, ownership, disclaimers, limitations, indemnity, and dispute provisions) survive.

13) Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law rules.

You agree that disputes will be resolved in the courts located in Queensland, Australia, unless applicable consumer law requires otherwise.

14) Changes to Terms

We may update these Terms from time to time.

The updated Terms become effective when posted, unless otherwise required by law.

Your continued use after updates means you accept the updated Terms.
